Hello,
my girlfriend and I intend to buy a plot of land in Brandenburg (through a real estate agent).
Now we have received a draft of the purchase contract from the notary and have some questions about it. Maybe someone here can answer them??
1. The notary is based in Kiel. According to the seller, this is historically established. Is it true that there are different fee structures for notaries depending on the federal state? I could only find information stating that there is a nationwide uniform fee schedule.
2. Since we do not want to travel from Berlin to Kiel for the notarization at first, the notary offered us to declare a representation without power of attorney by means of a written consent, so that we would not have to appear in person at the notarization appointment. But wouldn't this invalidate the transaction, since the document must always be read aloud when buying real estate?
3. In the draft contract, the purchase price consists of the land price and ancillary building costs. The ancillary building costs are broken down into a. general surveying services and b. advance payment for sewage connection.
Apparently, this was designed so that the land price did not have to be increased and thus real estate transfer tax would be saved. But isn't real estate transfer tax paid on the entire purchase price agreed in the contract, or are there exceptions? Should we have the ancillary building costs billed separately as an annex?
