If everyone separately and only the declaration, as a construction contractor, is not economically and/or organizationally connected with the land seller – although I do not see any entanglement with the municipality and the subsidiary settlement company – then such a document might be a negative indication – but by no means a free pass. However, if everyone signed the same paper, the document itself already perverts its content and is more than worthless.

It would be interesting to know what a notary is allowed to charge for such a "statement" and whether the value of the object is again decisive. But even the "post/telephone flat rate" alone is actually outrageous.

After the purchase, a questionnaire usually comes from the tax office (with a slight tendency towards trick questions...), which one fills out or (as in our case) writes a short explanation as to why the questions are not applicable. For example, because no house construction contract has been signed yet. It takes exactly 10 minutes and a postage stamp.

I will keep you updated on the costs that have been incurred due to the letter as soon as the invoice arrives. That should be the case sometime this week.

Possibly we will receive a copy of the declaration. Then I will also post it here online.

In our case, nothing like that came. Only the notice of what is to be paid, and only the purchase price of the property was taken as the basis.

Fact is. Notaries do not handle new construction contracts. They either handle pure land contracts or contracts for land with an existing house on it. As long as only land is purchased and nothing else happens, there is no tied transaction. k

...unless the seller is a well-known house construction company or a real estate subsidiary. Every tax office knows that no plots of land are sold without a building contract there.
