Proof of equity to prefab house company: questions experiences?

I don't know what you want to tell me. Of course an acceptance took place, otherwise I would hardly be living inside. An acceptance by no means means that everything has to be paid. And how should I fail in court? I'm not even going to court. If the general contractor wants my money, then he has to do something. If necessary, he has to sue for it. But that will be difficult for services that were demonstrably not provided.

What that has to do with the assignment is stated above in the text.

And a 10k retention is not necessarily a serious defect. You may withhold double the cost of rectification, so we are talking about something that can be done for 5000€. This is reached very quickly, especially when several trades are involved ;)

Thank you for the input, but it is proving to be more difficult than expected, as none of our banks do something like that. [Notaranderkonto] is also ruled out. It remains exciting...

Have you found a solution in the meantime? We have the same problem. Our general contractor requires a pledge/assignment so that he has the security that we do not use the money otherwise until the payout date. None of the banks we asked agree to an account lock without an assignment…

Yes, after a lot of back and forth we finally managed it through the bank where we have the loan running. But it was a lot of hassle, a lot of going back and forth, and a lot of goodwill from those involved; it helped us that the bank had done something like this (at another branch). In my opinion, for the bank it wasn’t really a big deal – open a daily allowance account, block it, confirm, done.

All other banks refused to do it (especially if you’re not a customer). A guarantee loan is also out of the question for private individuals. A notary escrow account won’t work either or you’d have to look for 20 notaries (we tried 5, all declined).

What does your house bank say? Otherwise, if the general contractor wants it and that’s “usual,” he should ask his house bank if they will do it. What does your contract say about this point? Is it regulated? In our case, unfortunately it was, and I didn’t give it much weight at the beginning.

Sorry that I can’t show a “sure way” here; it was quite a ride for us too.
