Plot including green area - Questions about the green area

Hello everyone,

we want to build in about 2 - 3 years. Where we live (NRW), building plots are scarce. Now we could acquire a plot from the municipality, which consists of about 650 sqm of building land and about 400 sqm of green space.

We would like the plot and also because of the green space, it is practically impossible to build any further. Now I have a question about the green space, namely what am I allowed to do with it besides maintaining it? The entire plot has a slope and sooner or later I would level the green space to make it more usable (for playing for the planned children, etc.). Am I allowed to put a garden shed on such green space or would that already be considered construction? What am I actually allowed to do with the green space?

Hello Tom,


This is usually evident from the sales documents. Quite a few municipalities actually expect you to "only" maintain it.

Ok, then I have to contact the municipality and inquire.
It would be a shame if I couldn't use the area at all. I would at least have to level it so that it can be used effectively, meaning it could be used as an additional garden or playground for the children.

We also have such green spaces. Officially, the green spaces belong to the municipality, but they are maintained by the adjacent owners. As "compensation" for the maintenance, the residents are also allowed to use this area. As a result, you will find children's play equipment there (trampoline, slide, swing) and even the occasional small garden shed. Therefore, it is best to check with the municipality what they allow and what they "turn a blind eye" to.
