Hello everyone,

I would like to ask what exactly "planned start of construction" means in a house construction contract. In our contract, the planned start of construction is January 2019 and so far only the excavation is finished, but according to the contract the official start of construction is when the foundation slab is done, and the construction company has not said yet when they will start with the foundation slab. What else can we do besides waiting? Thank you

What does the developer say? The word "planned" allows for many interpretations. It is not "guaranteed."

As HilfeHilfe already wrote, the "planned start of construction" is not a fixed date. Have you already contacted the construction company, called...?
I would do that first before writing letters and setting deadlines that probably wouldn't be enforceable anyway. Especially since you still want to build with them...
Presumably, others were more active/louder and got priority.

As already stated, you have no legal recourse due to the wording "geplant". Do you have a guaranteed completion date and "Vertragsstrafen" for failure to meet this deadline? If not, then you can only wait (a long time).

Hello, we have been talking on the phone almost daily since May, we had meetings, always it is "soon, next week....." the problem is that the company is a general contractor and always says that no mason can be found to come to us. We do not have a completion date, only 9 months after the start of construction and the start of construction is when the foundation slab is finished, and until now we do not have that. As it looks, I believe that I have little possibility, right? Thank you

And what else can I do? Just wait or are there other options?
