Perfect plot - suboptimal house building company?

Hello everyone,

in my search for a plot of land or a house, I found a perfect plot, but as so often, a house-building company already has their hand on it.

I also found this plot through this company, Schwabenhaus, and was initially quite impressed by the first impression. From various sides, I also heard that Schwabenhaus actually has a pretty good reputation.

Afterwards, I googled and unfortunately found very negative reports about the salesperson M.S.

The problem is that plots in the location I’m looking for are almost impossible to get from private sellers. They go to brokers who immediately pass them on to construction companies.

In my circle of friends/acquaintances, I have an architect, a plumber, and a lawyer. All would help me to put together the contract with the services rock solid and later also supervise the construction.

What do you think, stay away from everything involving Mr. M.S. or would I be dealing with other, hopefully competent experts anyway after signing the contract? Would expert support help me to get the house built properly?

The problem is that the owners have already signed with Schwabenhaus, so I cannot avoid it if I want to build there. And the location is simply great, you don’t get something like that easily again.

Hello,

First of all, the following: none of your acquaintances will be able to help you, since the provider will hardly change the contract terms so that you can buy and build on the plot. If it is truly, as you describe, the perfect plot, other interested parties will be found who will sign without any "ifs" or "buts."

The next point: I personally organize plots from private individuals because, for various reasons, it is more sensible for interested builders, among other things, they save on brokerage fees. For this, I conclude an option contract with the plot owner, which runs for "x" months under exclusion of other providers being allowed to market the plot.

Many plot owners, however, have no sense that by marketing their property multiple times, they diminish the value of their plot; they have an "open" agreement with various providers. You seem—at least that’s how it reads—to know the plot owner, so in your place, I would simply inquire whether and if so, how long his option agreement with the above-mentioned provider runs and whether there might possibly be ways for you to purchase the plot directly from him.

That is definitely better—even renouncing the plot—than recklessly plunging into an incalculable risk.

I do not want to change the contract design at all. However, I hope my specialists can tell me whether I am on the safe side with the contract I receive. If not, the whole thing is dead anyway.

I cannot avoid the company for this property also because it is a semi-detached house, and one party has already signed.

Would you still not even look at the contracts?

If you ask me, no.

I have been in this business too long – know too many competitors or their policies and partly frequently changing people to be able to say yes with a clear conscience.
