Market value in a ground lease agreement

Hello everyone,

I have received a notary invoice, although I still wanted to notarize the leasehold agreement.

I am particularly interested in: How is the market value calculated? Is the annual ground rent extrapolated over the entire contract period (e.g., 95 years) or are there usual limits?

So this is about the business value when ordering a heritable building right. Pure land without buildings? Other rights such as pre-emption rights or value adjustment?

Land is capitalized over 20 years. In addition, a comparison calculation is made (I believe 80% of the land value). Then there are additional rights as mentioned above.

But the interest is not simply calculated over the term.

Pure land without any buildings.
No further rights. The landowner has the pre-emption right.
For me, 4,498 euros annual heritable building right interest was calculated over 95 years. That means market value 472,310 euros.

Very unusual. I would question it with the notary.

Thank you, I had looked it up, it is clear. I sent the notary an email about cost disclosure. Also to arrange an appointment for notarization. He simply does not respond. He is probably offended that I am questioning his invoice.
