This is all bureaucratic language that I do not understand or only partially understand. The question is, how can I secure my "right" not to pay if a service is not rendered or is defective? An assignment can be revoked, right? I just need a form or an example of what such an assignment declaration looks like.

In general, no, because the assignment is formulated as "irrevocable." As far as I remember - but I am not a lawyer, so you should inquire at a more competent source - this clause is not legally enforceable.

Thank you very much for the response. But can't I attach a condition to the assignment? For example, that it should only apply if lawfully asserted claims are not paid by me and the respective construction phase has been completed without defects? That would be an option.

Of course, you can try; whether your provider agrees to it is the important question that only they can answer.

Did you purchase so many additional items during the sample selection, or why is the financing confirmation no longer sufficient for them? For which installment payments should the assignment be issued?

No, hardly any additional costs were incurred during the sampling. But the house connection costs and development costs have skyrocketed. The assignment shall be made over the full purchase price amount.

Was that the house company?

Have you built with them now?
