Hello everyone,
we want to build a two-story house in the village. The plot is located at the very edge of the village and cannot be seen from the main street. On the phone, I was informed that you can only build something there that can also be seen in the surrounding area (§34 Building Code). On the street itself, there are only 1.5 stories with gable roofs and plaster. However, on the side street, there is a 2.5-story building made of old brick. Now my question: does this also apply if the building can be seen but from afar you cannot tell how many stories it has? And could you also choose a different roof shape, or do you HAVE to choose a gable roof here? And if you have to, can you change the angle? And could you also choose clinker brick or a combination?
PS: please understand, we are absolute beginners.
Best regards

Nice photo. What is one supposed to see in it? The number of storeys, at least the strict definition according to the state building code, is secondary. More important are the eave and ridge heights of the immediate neighboring buildings. What is one street further usually does not play a role either. For assessment, an excerpt from the land registry would be helpful, preferably with the ridge directions and approximate building heights.

If by "the whole thing" you mean the provisions of §34, yes.

Yes. The roof shape cannot be prescribed by §34. For that, a local design statute is required.

Yes, unless there is the aforementioned local statute and it prescribes something else.

What is one supposed to see in it?

The brick house between the houses is meant. However, 2VG is about 200m away in a side street.

Then it no longer belongs to the immediate vicinity within the meaning of paragraph 34 of the Building Code.

Village is not just village. With us, they are happy about anyone who builds or renovates in the town center and is accordingly accessible Make an appointment at the town hall, show pictures of your dream house and ask if they approve it
