Land use plan designated as residential construction area

Hello community, we are farmers and have a green area of about 10,000 sqm. Now we would like to build a stable there. Unfortunately, the community says NO. The area is designated as residential land according to the land use plan. What now? It is not yet building land, as it still needs to be clarified what the federal railway plans regarding a track extension and the corresponding noise protection. But that can take time. I did not want to sell my meadow at the grassland price (1,- € per sqm), because building land costs about 125,- € per sqm here. However, waiting is also not good for me, because the animals need their stable. So what to do? I would be glad to receive tips and advice. Regards Helmut-Karl

Hello 11ant,
we have pigs and they need a permanent stable. ( Max. 100 Tiere mit Auslauf und Stall ).

You will have to look for another plot of land for the stable, for better or for worse. The decision of the municipality seems to me to be in accordance with the law:
§35 Baugesetzbuch
(2) Other projects may be approved on a case-by-case basis if their execution or use does not impair public interests and access is secured.
(3) An impairment of public interests exists in particular if the project
1. contradicts the representations of the land use plan,


Waiting will also bring nothing, because if a development plan is drawn up, the stable will almost certainly not comply with the regulations.

Hello Escroda, Thank you for your professional explanation. My problem is that I do have the property but cannot use it. Looking for another property, however, means spending money, but where to get it from....................... Regards Helmut-Karl

You are allowed to use it, just not to build on it. At the moment, it is a problem that you have one hectare of land designated for future development. In perhaps – let’s say – five years, it will be a blessing. The property is currently not buildable, but it is useful as collateral for a bank. You still have other properties. And where are the pigs sleeping now?
