Exactly, free of encumbrances refers to the land register. Usually, the contract explicitly states that no inspection of the [Baulastenverzeichnis] will be conducted; that is the buyer's responsibility.

I am not familiar with that. I sometimes deal with agricultural land. There are often such encumbrances, pipeline rights for natural gas, power lines, etc. The notary always points them out and explicitly mentions them in the contract.

These are also classic easements (civil law securities) and not building restrictions (public law).
