The following problem: A farmer wants to sell a property that is approximately 4000 sqm in size. He is not allowed to sell it parceled because otherwise he would fall under the real estate brokerage business and would have to account for it tax-wise. Therefore, he wants to sell it as a whole. We are 7 guys who are considering buying the entire property in order to then divide it among ourselves so that each has a building plot that is freely available (each about 500-600 sqm). The question now is: If the farmer is not allowed or cannot sell it parceled, how do we proceed? Do we have to buy it as a GbR, does one person have to buy it alone and then gift or sell it? The question remains open to us as to how we handle it if we buy the property and then have to or want to divide it afterwards. Looking forward to an answer
