Hello,

I urgently need some advice from you, I will soon start with the outdoor facilities, since I have built about 150cm towards the neighbor on a slight slope, I have thought about placing 150cm high L-shaped stones at the boundary to stabilize everything. Do I need to get a special permission from the neighbor to lay them up to the boundary?

There are different opinions on this topic on the internet.

Thank you very much in advance

Regards

Since you have to excavate from his property because of the foundation, I would talk to him about it; otherwise, you can approach his boundary up to -0.000001 mm.

Is it not allowed (depending on the development plan or law) to intercept only a certain height?

The answer is nice - but unfortunately wrong.

,

please check the development plan to find out how much you are allowed to alter the height of your property without a building application. A local change of +/-1m usually requires an application and approval and may also trigger building restrictions.

Before you go to the building authority with questions, it is better to ask your architect and/or surveyor about this.

Google tip: "Bauordnung NRW §6 Kommentar"

The result leads to a page from "mbwsv.nrw.de". Pay special attention to the points "4.2 Excavations" and "10.3 Accessible structural installations", then a lot will become clearer.

Roughly judged from the computer: you are probably on the safe side if you intercept a maximum of 1m and let the rest gently rise at a distance of 3m from the boundary. If it absolutely has to be 1.5m, coordinate with the neighbor and the architect beforehand so that it can at least be approved afterward if it ever becomes noticeable.

Best regards

I thought it was about the proximity to the border, not the height. It was not clearly recognizable to me.

I would also check the height. We were able to go up to a maximum of 1 meter high. That was approval-free. But there are also experts here for something like that
