Is the architect's fee justified?

Hello people,

my name is Bernhard and I have a question for the smart people here in the forum, unfortunately we have to give up our dream of a house, and now it’s about the architect’s fee, he has prepared the following calculation

House 2000m3 x 280€ =560,000€
Building services 2000m3 x 47€ =094,000€
~650,000€ cost for the house, 10.5x13m which seems very high to us.

then he calculated 64,000€ architect’s fee from the Hoia table line 3.

and then he applied 16% of that. 3% for stage one and for stage 2 7% +3% because it took longer until we had a reasonable plan and he drew 6-7 sketches. and 3% for stage 3 because as mentioned we had 6-7 sketches and once a plan with exterior view garage windows etc.

can I have this checked somewhere? With another architect or lawyer or is there something like a consumer advice center for architect contracts?

Regardless of the fact that I do not want to address the estimated (chargeable costs of the planned construction project) total sum for the new building – I also cannot, because I have no information on how the sum TEUR 650 was determined – the HOAI provides that fees for certain services are to be invoiced "from" – "to" in accordance with the chargeable costs.

Your architect calculated his fee according to § 34 HOAI. The introductory text reads:

§ 33
Service profile for buildings and space-forming expansions

The service profile for buildings and space-forming expansions includes services for new buildings, new installations, reconstructions, extension buildings, conversions, modernizations, space-forming expansions, maintenance and repairs. The services are summarized in nine service phases and are evaluated as follows in percentages of the fees under § 34:


then follows the table of fees, divided according to fee stages.

If I compare the "binding" fixed values therein with your information, then your architect has charged at the upper end (legitimately), also – for me somewhat confusing – for stage 2 but also "reasonable" with regard to stage 3. In other words, he has not acted improperly in terms of his invoicing method.
