Is it allowed to position privacy screens arbitrarily on your own property?

Hello everyone,

I have the following situation: Last year around the time of our move, we chatted with the neighbors and agreed that we wanted to plant a hedge as a boundary fence along the property line. Basically, I still have no objection to that, the hedge may very well be planted right on the border. However, a few days ago the neighbors erected a shed along the border. A rather monstrous thing made of silver corrugated metal. Of course, there's nothing wrong with that, but it's not exactly the view we want to have while having breakfast on our terrace.

I would now like to install a wooden privacy fence on our side of the property, something with a bit of a trellis, and plant greenery in front of it so that when looking towards the corner we see a nice garden rather than the metal. Am I allowed to do that without any further ado? Do I have to keep any distances? I attached a sketch where I marked the metal part in gray and our desired privacy fence in yellow. Of course, I wouldn't do something like this without discussing it again with the neighbors beforehand, but I would like to know where I stand legally. I can hardly find any information on this topic online, only info about fencing as a boundary fence.

Clear to the neighbor, you may do whatever you want, just not higher than 2m.

I bet he wasn't even allowed to build that monstrous thing. Not there! ... up to 1.80 meters, as far as I know, you may build something directly on the property line. Most privacy fences are designed that way.

You think so? We also have our carport directly on the boundary, the construction company and the municipality had no problem with that. The shed is not directly on the boundary, a few centimeters onto their property. I don’t want to pick a fight with them over something like that. I just want to make my side nice.

If the shed is new and was not included in the original building permit, you would probably need a building permit and you should have received a corresponding building notification from the municipality.... a few cm distance is irrelevant; boundary construction must be permitted and the maximum meters allowed for it must not be exceeded.

I would clarify that in your place; then talk to the neighbor, if it is not approved, then you can probably freely work on the boundary and he is not allowed to complain..

That is then an enclosure by fence if you go up to the boundary. This is regulated by neighbor law in the federal states or the development plan. Behind the boundary, however, you are free to build as you wish.
