Is a soil survey necessary for disposing of excavation soil?

Good evening.

The excavation is included in the price of our turnkey built house. However, the disposal is not.

We were informed that since this year a soil assessment must be conducted due to the disposal. There are supposed to be categories 0,1,2.

We now have the option to place the excavation with a friendly farmer or my parents, who want to raise their 2500sqm garden a bit.

The only question remains:
Officially, from category 1 onward, you are apparently not allowed to use the soil even in your own garden and must dispose of it expensively at the landfill.

How does it look in practice? Is it checked where the soil ends up or do you only need the assessment if you take it to the landfill? Is the soil assessment always checked when you build?

If you bring the soil from private to private, nobody wants to see an expert report. How much soil is it? Maybe I would keep it for now, with the garden layout you might be able to use some of it yourself.

Why should you not be allowed to use what is already on the property?

Soil analyses of the soil are carried out by the disposal company, and this is done with every _Entsorgung_. These costs are usually included in the price by the earthworker during removal. If you want to give something away or hand it over privately, then _Entsorgung_ is not applicable, so these costs also do not apply.

Thank you for your answers, that reassures me a lot.

We will definitely keep some soil, but it is a slightly sloping plot and more will probably have to be removed when designing the garden. But we'll see about that when the time comes.

The construction consultant from our building company explained the soil situation to us like that. Either we misunderstood something or he was misinformed. But he definitely thought it was stupid if you are not allowed to reuse the soil already on the plot because it is the wrong category..

My experience is that you should have this done once by the geologist who also prepares the soil report. He stores the soil samples for 6 months anyway, and the chemical analysis can be commissioned at any time. Here it costs almost half of what a disposal company indicated.
