Installed sanitary fixtures defective, who bears liability?

Hello,

I have commissioned a plumbing company to lay pipes and subsequently install sanitary fixtures (toilet, washbasin, bath, etc.). We purchased the sanitary fixtures ourselves and had agreed that the plumber would install them.

We ordered these online and the plumber unpacked and installed them. During the acceptance, we noticed scratches that the plumber did not inform us about. He is certain that he did not cause them.

We would like the plumbing company to replace these since they unpacked everything. Who is liable for this now?

You. You bought the material and he only installed it. Can you prove to him that he caused the defect? Or is something else agreed upon in the contract?

With something like this, you need to be present and do a preliminary inspection of the devices. That is a price in time you have to pay for self-procurement – which usually saves money. It was the same with our last kitchen.

Was it your goods delivery?! Then it is your duty as the recipient to check whether everything has been delivered completely and without defects. What happens to it later or is done with it does not matter.
