House renovation problems with the attic / mezzanine regulation

Hello,

we want to renovate our residential building (1 full floor + attic) to 2 full floors + attic.

In this step, we are adding 2 balconies for the upper floor + attic.

The following problem:

In the HBO it states that the attic or recessed floor may have a height of 2.30m and a maximum of 3/4 of the area of the floor below.
By area, they mean the gross floor area, right?
Does the balcony of the upper floor count towards this or not? As far as I understand, it does not count.
If I were to convert the balcony into a loggia, would it then count?

I am doing the planning myself (Bauingenieur Student im letzten Semester). An architect will join soon. Until then, I want to complete the planning as much as possible.

Bachelor or Master? As an economist (Diploma), I could not create a business plan for a company in the last semester. Reason: lack of practical experience and theory is far from practice :)

Bachelor, yes the preliminary building inquiry is already approved. I just came across it now. The idea is simply that if the loggia on the upper floor counts as floor space, then the balcony in the attic counts as a roof terrace, so I could plan significantly larger dormers, etc.

What do you even mean by "full floor" there? - do you want to add a second straight-wall floor plus a living space attic on top of one straight-wall floor (plus currently a storage sloped roof attic), or even a set-back floor and a set-back set-back floor? - how much height is allowed by a. the development plan and b. the setback areas at all?
