I tolerate everyday noises. I do not tolerate a bass-heavy outdoor speaker with terrible music on a Sunday. There have already been various comparable cases that were tried in court where judges shared the same opinion. I even read about a ruling where it wasn't about the sound level itself, because the judge believed that the use of a loudspeaker on the terrace in a residential area was not to be considered part of usual property use. That would also correspond with the fact that no one else in the entire neighborhood does this except for one party.
I have the little brother with cable. :) Maybe I'll upgrade to the QC35 someday.
I am fairly sure that you are at least partially right. But enforcing it the "hard way" will destroy your relationship, and that can escalate badly. I would think carefully before going down that path. Then the neighbors will be watching your every move 24/7 to catch you doing something wrong. If you respond with excessive noise, the neighbor might soon have a PA system on the terrace. Just wait and see; if he already has legal proceedings due to noise disturbance, it should be quiet soon.
