I feel the same way. The upper properties have nothing to do with it, as they remain unchanged. The water has always flowed there both above and underground. Your neighbor's construction causes the problems, so he must ensure that the problems are resolved.

I cannot provide judgments. But the Hessian Neighbor Law is IMHO very clear § 21 NachbG – Drainage and Inflow (1) Wildly flowing water is surface water flowing outside a bed, originating from springs or precipitation. (2) The owner and the users of a property must not 1. increase the outflow of wildly flowing water onto neighboring properties, 2. prevent the inflow of wildly flowing water from neighboring properties onto their own property, if this significantly impairs the neighboring properties. Court rulings can only deal with the question of what "significantly" means. For support, also HBO § 13 Protection against harmful influences 1 Structural installations must be arranged, constructed and functional in such a way that dangers or unreasonable nuisances do not arise from water, moisture, weather influences, plant or animal pests, or other chemical, physical or biological influences. 2 Building plots must be suitable for installations.

I wanted to provide the rainfall amount. In the neighboring town, there was about 54l of precipitation in approximately 12 hours. I already think it's good that my drainage can handle that.

We plan to have a conversation with the neighbor and his planner in the next 2-3 weeks. I am curious. For now, we are sowing grass.
