Full floor in the attic? Bungalow or 2-story house?

Good evening everyone,

my husband and I have been looking for a suitable building plot for some time. Now we may have found a suitable piece of land, but I am still having some difficulty with the terminology in the development plan. It says:

"1 full storey permitted. An additional 2nd full storey may be created in the attic. Also, in the case of a hillside location, a basement. Roof pitch 20° - 55°"

"Prohibited installations: knee walls above 0.75 m height, external use of shiny or embossed plastic, lightweight, or metal building materials"

So what exactly is allowed to be built on the plot? A bungalow? A two-storey house where the 2nd storey may have a knee wall of max. 0.75 m?

Since our plans are not yet very concrete and we therefore do not yet have an architect on board, I hope that someone may be able to help us this way.

From the text alone, it is not clear to me either, or rather, I find it unclearly formulated. It may be meant that legally a second full floor may be created if it does not appear so from the outside.

It’s best if you write down – avoiding links that are not desired here – where to find the development plan: that is, the name of the municipality, the name of the building area, the number of the development plan – then we’ll find the thing if it’s online.

thank you very much for the quick response! It concerns the new development area "Am Schoppen" in postal code 97268. The development plan can be found right under the first link on Google.

Very, very badly written. This can only lead to misunderstandings. Which property are you interested in?

Well, basically it is quite clear. A: For those with "actually" a full storey: ground floor + attic as full storey (= 2 full storeys) (+ in the case of a slope, the basement as a full storey) B: For those with two full storeys: ground floor + upper floor as full storey + attic as non-full storey (as long as the floor area ratio is not exceeded). The wording simply makes it clear that in situation A the pitched roof comes above the first full storey - but it can be designed so that over the entire area the heights required for a full storey are available. In situation B, above the first full storey there may be a second one and only then comes the roof (storey).

Additionally: Exactly, a two-story house (with an additional basement in the case of a hillside location) including the roof, where the knee wall has a maximum height of 0.75 m, but due to the roof design (which may vary depending on the federal state), the height over a certain surface area of this attic floor meets the conditions for full floor status. In Hesse, for example, the following applies: "Full floors are above-ground floors that have a height of at least 2.30 m. A [...] floor with at least one pitched roof surface is a full floor if it has this height over more than three quarters of the gross floor area of the floor below. The height of the floors is measured from the top edge of the raw floor [...] in floors with roof surfaces to the top edge of the supporting structure."
