Floor area ratio; § 19 para.4 Building Use Ordinance - experiences?

Hello,

I have some questions about § 19 Abs.4 Baunutzungsverordnung.

Facts:
Plot = 554.6m²
Floor area ratio = 0.3
To be built on = 166.38m²

My idea with § 19 Abs.4 Baunutzungsverordnung:
Floor area ratio = 0.3 + 0.15 (50% of the specified floor area ratio) = 0.45
To be built on = 249.57m²

Is my idea correct?
Which areas would fall under this?
Does § 19 Abs.4 Baunutzungsverordnung have to be included in the development plan in order to apply it, or does it always apply?
Or is my idea complete nonsense?

Your development plan states everything about the floor space index in §3. The "surcharge" for garages and driveways does not have to be assessed by the municipality at 50%; I find the regulation made here with the addition for pipehead plots exemplary.


By the way, the "surcharge" is "earmarked"; unused driveway area may not be added to the house. In this respect, your idea (of casual sum formation) is indeed nonsense.

You have already applied the factor 0.3 correctly. If the [Baunutzungsverordnung] were to replace development plans, then development plans would not be necessary. It is therefore cited as a basis where its regulation is to be adopted unchanged. However, commendably, more advanced considerations have been made here.

Depending on the federal state, roof overhangs, bay windows, etc. can also be included in the plot ratio. It is therefore not advisable to try to exhaust it solely with the base plate. Moreover, when the floor area ratio is specified, both apply as maximum values. You must therefore also observe your floor area ratio of 0.45. Thus, despite two possible full floors, the floor area ratio of 0.45 also applies. Roughly estimated, you should keep the base area below 155 sqm.

Yes, the calculation is wrong. For the main building, a maximum of 166.38m² built-up area is permitted.* For garages etc., you may exceed this limit by a maximum of 0.15*166.38=24.95m².

*As 11ant already writes, you should not exploit this fully or rely on the information in the "Haussteckbriefe".

the floor area ratio here does not only apply to the main building; exclusively to the "Pfeifenkopf" properties (and even there explicitly only related to the access way) is an exceedance allowed.


Where do you get this (additionally unusual) 15% surcharge from?
