Fill up the plot - we are doing it now, neighbor is waiting

Hello everyone,

we are developing a plot of land with a slight slope. The entire plot is to be filled up by 0.30 m - 1.10 m. The neighboring plots (to the left and right) look exactly the same. In total, I have to retain just under 65 linear meters of land with a wall, shuttering stones, or something similar.

I have not yet been able to locate the neighbor on the left. I contacted the neighbor on our right side and wanted to find out if he plans to fill up, because then you could possibly fill up against each other and thus save the costs for L-stones or similar.
He told me that he wants to wait until I have set the L-stones since I will fill up anyway. He will then fill up against my L-stones and save himself the costs of retaining.

This statement made me somewhat angry. Sure, I have the problem if I build first and he can react to me, but I find the manner impossible.

Now I am naturally wondering what options I have.
My first idea would be to set L-stones, but not exactly on the boundary, rather to sacrifice a 10 cm strip. I would imagine that then he is not allowed to fill up against that but must pay for his own L-stones.

Do you see any other possibilities besides talking to him again?

I would bring it up again - calmly. If he really meant it THAT way, it would of course be selfish and also stupid, because nobody benefits from a negative neighborhood relationship. Better to negotiate a bit more and clearer beforehand than to want to get even later with the 10-centimeter distance, because the anger and resentment would then remain with you. In the end, he will still dump his earth against your wall and then...?? Lawyer??? Oh dear... better not. Tell him exactly that clearly, that you both could benefit from each other and share the costs. If he really doesn’t go along with it, I would tell him clearly that I find this unfair and that it would be a pity for the future neighborhood if you had to bear this disadvantage alone or he would benefit for free from your preparation. Only if all that doesn’t help would I give it further thought. I would probably wait myself then as well........ I would try everything possible to avoid conflict even though from my own experience I know that some neighbors really aim for it and do not shy away from gaining such an advantage from something like this.

That already sounds very childish! However, the statement from the new neighbor is also cheeky. I would simply pile up completely and then let the embankment naturally slope off on the two sides of your property for the time being. At 45 degrees, that might later result in about 1m width... Then you are flexible and can still set the L-bricks afterward if necessary or pile up against your neighbor only after sufficient discussions.

This is kindergarten from both sides - are you clients or three-year-olds now? It is reasonable not to make any steps at the borders at all, to fill up as little as possible, and to compact together across the border. Why clients go around banging with L-beams like bad window installers with construction foam, one does not have to understand as an adult. Peace!
