Hello everyone, I am building on a small slope and to get a straight terrace, instead of 1m as described in the development plan, I have excavated 2m deep for the terrace. What consequences do I have to expect now? Is it enough if the neighbor next to me does not excavate as deep if I support at my own expense, or am I facing a penalty? Thank you all.

Hello,

Replying here would be like consulting a crystal ball.

Go to your building planning office and ask about possible solutions or consequences. AND - treat your counterpart the way you want to be treated yourself, then things will go smoothly with little trouble :-)

Rhenish regards

in the worst case, dismantle. Procedure: apply for exemption from the development plan. Then you either have to dismantle (usually not) or you get approved. If you do nothing: In the worst case, the building authority (usually the district office) will not give you the acceptance / approval, in other words illegal construction,... Then they either force you to dismantle, or you have to pay a fine, or nothing is done.

Isn't it enough if I set support stones up to the allowed height?

You are doing it differently than the development plan requires. That would be a technical solution that argumentatively justifies the exemption from the stipulations of the development plan. If it says you are only allowed 1 m, then you are only allowed 1 m - period. Everything else must be exempted / approved. When the development plan was drawn up, there was a reason why only 1 m is exempt from approval. Take the construction expert's advice and go to your building authority, they will surely help you, if not: submit an exemption application, then the municipality / city council must decide whether it is justifiable - if they reject it, you can complain to the building supervisory authority (district office) and file an objection, they can replace or confirm the municipality's / city council's decision.
