Error in the detailed floor plan by the developer

Hello forum

We are building a terraced house with a developer. All contracts have been signed so far and the house is under construction...

During the selection process, we were presented with detailed construction plans/floor plans for each floor, which we went through individually with the managing director and approved for execution with our signature.

In the basement, these plans show insulation attached to the basement wall that goes around the hallway. It is supposed to prevent too much heat from the ground floor entering the basement. Now we have been informed that the insulation is a mistake because the insulation must be installed by us and not by the developer.

Since I don’t want to have any stress with the developer over insulation, I would be interested to know what the legal situation is? In the written construction description, this insulation is listed as a chargeable additional service, but in the detailed plans that we signed, the insulation is already included...

How binding are these plans?

So, according to my layman's understanding, the most recently signed plans are always binding. The binding order should actually also be contractually stipulated. In our case, the order of the valid documents was explicitly stated in the contract for work, which read as follows:

- Offer / Preliminary plans at the time of signing the contract
- Building application documents / building plan
- Preliminary work plans
- Sampling protocol and plan
- Final work plan.

Whenever something new from us was signed in the above sequence, the previous one was considered void. After each change, we received new work plans.

In the end, the final work plan in conjunction with the sampling protocol applied and nothing else.

If you go by the order, it looks like we first signed the written construction description. We received the detailed plans for signature about a month later, and the insulation was included there.

@Bauexperte...
We only do the floor and wall coverings ourselves, everything else is done by the builder (turnkey execution).
