It somehow has something of a birthmark. Some embrace such a beauty spot, others have it removed. People have never been able to agree on the different perspectives. A person is also a natural product :)

Natural product or not. For me, that would not be acceptable and they may take the board back. Kitchen already fully paid? That would probably be the only leverage for exchange.

Everyone can handle it as they wish. Paying money to have a congenital beauty mark removed. Paying money to achieve a uniform appearance as seen, which then contains a visual flaw.
I would know what I would do in both cases ;).

If a specific sorting was not contractually agreed upon during the order and sampling, the customer will hit a wall. The seller can calmly refer to the DIN standard for natural stones.

Since we do not know what was discussed or pointed out regarding the countertop, the information sheet from the Federal Association of German Stonemasons, "BIV-Merkblatt 2.02 Kitchen Countertops," may help the OP. Section 4.1 contains some information on this.
