Employ a mini jobber as a construction helper?

Hello,

my brother and I are building a semi-detached house together and want to do most of the work ourselves. However, since we both still have our regular jobs, we would like to have someone who can support us occasionally. Of course, friends and family are also available, but that won’t be quite enough. Now we thought we could hire someone as a Minijobber. However, in another thread I read that this is not possible in this setup because construction helper activities are not household-related services and you can only hire a craftsman/construction helper as a Minijobber under a business. Does anyone have experience with this or an idea of how to officially employ someone as a helper without having to start a business ourselves? We are building without the intention of making a profit for ourselves.

This is completely taken out of a context unknown to me and mixed up. Just because it is not a household-related service and you cannot deduct it, you can still have someone work for these activities. By the way: a cleaning lady is also a mini-jobber and is engaged privately. Household-related services are services commissioned in an already existing household. It is important that they are insured against accidents. But this also applies to your friends, acquaintances, and so on. Construction helpers, whether external or not, are registered with the professional association (if I am correct) I do not know exactly.

there is a list of activities at the Minijob-Zentrale that are considered household-related services. And only for these may you employ a minijobber in a private household (e.g., cleaning, care, babysitting, etc.). Handyman work is not included. However, since we are only building for ourselves, we are effectively a private household. Handymen as minijobbers are employed by craft businesses. That means we would have to register a business. But then we would have a profit motive, which we do not have. So actually, I am looking for a way to legally and officially hire someone for a few hours or days as a construction helper without immediately creating a whole cascade of obligations. It is only about someone occasionally helping out, but more than a private construction helper like friends and acquaintances, who are not paid for this. As far as accident insurance is concerned, I of course have to register everyone with the BG Bau. We have already done this much.

Again: You are orienting and informing yourself incorrectly if you refer to [haushaltsnahe Dienstleistungen]. That is a completely different category than what you are planning. And no: it is not a household yet, it is a construction site, a house build. The fact that you are living somewhere now has nothing to do with it either, because you are not seeking help for your current household.

But a classic minijob for commercial activities outside of [haushaltsnahe Tätigkeiten] is only possible for a commercial employer. As a private person, you are not allowed – as a classic minijob – to employ craftsmen. Only a commercial employer may do that.

Maybe you should look for a freelance craftsman. So, the business then belongs to the craftsman. I remember a colleague. She always talked about her "house and yard craftsman" who did everything that came up in their house.
