Hello everyone,

I have to bother you again about the notary contract. We have now agreed with the seller and want to buy the property. Besides a price reduction, he suggested paying the broker fees since we actually wanted to buy without a broker. He told us this twice on the phone and also confirmed it to the broker.

Do you think we can now commission the notary contract? We have nothing in writing. But even that might not help us because our legal protection insurance doesn’t cover possible litigation of the claim or rather covers almost nothing related to buying real estate. In the notary contract, we want to state that he will bear the commission.

Would you take the risk now or have it put in writing? But then we wouldn’t have anything either. We are also a bit afraid that the owner/seller might get annoyed with us. After all, we do want the property.

Is it worth a thousand euros not to get your desired plot? If yes, annoy the seller and get everything in writing - as long as no one else buys it who is "easier to deal with."

P.S. Is the question really serious? If you start like this now, the construction phase will surely be a fun time for everyone involved :(

Broker fees of approx. 4200,-!! Have or not have... Would you also buy a plot of land for 60,000,- even though 56,000,- was agreed? Sounds like you don't care then...

Yes, if it is my "Wunschgrundstück," I don't care! It's "only" €4,200, so 1% of an average house construction. And the land price is quite low when considered in €. Seems there must be a catch with the land if the seller already suggests reducing the price and taking over the broker ;)

We have negotiated the discount. And we did not want to pay the broker fees, he said that he would cover them. But well, this completely misses the point here...

I personally would ask the seller + agent to confirm that to me in writing. Even though Nordanny is absolutely right with his statements. Nevertheless, it involves a lot of money and if an email/fax clears that up: all the better.
