Development plan - single-story / two-story height

Hello everyone,

I have a very general question for you:
I am considering buying a building plot and would like to build a two-story house with a flat roof there.
The applicable development plan distinguishes between some plots where two-story buildings are allowed, as well as most plots where only one-story buildings are allowed. The roof shape is open.

The wording in the development plan is as follows:

Height of the buildings:
The FB OK (top edge of finished floor) of the ground floor, measured in the middle of the facade, must not be more than 0.75 m above street level.
The maximum eaves height for an allowed one-story building with pitched roofs may reach 4.2 m above FB OK. The ridge height may be a maximum of 9.0 m above the reference point.
The maximum eaves height for an allowed two-story building with pitched roofs may reach 7.0 m above FB OK ground floor. The ridge height may be a maximum of 11.0 m above the reference point.

For shallow pitched roofs with a roof pitch of up to 10°, the building height (Gh) for an allowed one-story building may be a maximum of 7.5 m above FB OK ground floor.

For an allowed two-story building, a building height of up to 10.0 m is permitted.

Am I correct in assuming that I can also build a two-story building with a flat roof on plots where only one-story buildings are allowed, as long as it is not higher than 7.5 m?

No.

See the definition of what a full story actually is. Here is the excerpt from the NRW State Building Code:



So you could build a ground floor, and on top of that, for example, a setback story with a flat or shed roof. Or a second floor/upper floor whose ceiling height remains under 2.30m – however, that would no longer be living space, but rather usable space.

This is also a direct example of how you can reach 7.5m height with a full story, even with gently pitched roofs.

No. I suspect your quoted text comes from the "textual provisions" of a development plan that has several zones. In the graphical plan you can see which area your plot belongs to. If there is a Roman "I" there, you cannot build two full stories. Your second story may then only be smaller than the first—possibly with a flat roof as a "setback story," or considered smaller due to a sloped roof according to an area calculation standard. The same size as the first story is not allowed. The plots where two full stories are permitted are those where the area is marked with a "II."

That is what I wanted to point out as well The text refers to the entire area, which is, however, zoned (1- and 2-story) Furthermore, it reads as if no flat roofs are allowed, but only pitched roofs up to 10 degrees. Regards, Yvonne

Since there is no definition of flat roof in either planning law or building regulations, the planners have commendably chosen a wording that avoids the term "flat roof" and the potential for dispute over its maximum slope. Therefore, all roofs with a slope of 0° to 10° are meant.
