Development plan for a multi-family house

Hello, my husband and I purchased a plot of land in a new development area last year to finally realize our dream of owning a house. We deliberately avoided a plot next to properties designated for multi-family houses and chose one directly in the settlement. Today, we met our new neighbors diagonally opposite who told us that across from us and next to them, the owner of the plot is planning a multi-family house with 6 (!!) units. When selecting the plot, we specifically emphasized that we did not want the other plot to avoid living next to a multi-family house. And now this? Is it really allowed to build a multi-family house on a "normal" plot? It should be noted that the development plan is quite generous (you can build relatively high and also excavate somewhat because it is a hillside plot, and the building envelope is quite large). All of this was of course appealing to us for our house. We also had our development plan reviewed by an expert. But to have someone build a bunker opposite us (on a plot intended for a single-family house), we never would have expected that in our lives. We are deeply disappointed and could cry. All our money and savings are going into this house. The builder apparently complies with all the regulations of the development plan (??)… Is there anything we can do after all?? What does the B plan really say? If multi-family houses are allowed, then they are allowed. If not, go to the building authority and formally file a complaint.

What exactly do you see as the danger coming from a multi-family house?

It may be that, due to the hillside location, some nice calculation tricks with the "full floors" are possible. But at least what you see from the "mountain side" remains in the building volume within a framework that fits into the neighboring buildings. A friend of mine lives in such a four-family house on a hillside, which has two underground floors. From the upper street, it looks like a single-family house (one and a half floors) with four parking spaces and four doorbells. Everything is within the green zone.

In a new development area in my town on a hillside, some corner plots also have such "luck" to get more living space out of the building plot. Apart from the neighbors' envy of this advantage, there is no "unrest" from it. Most multi-family houses are unremarkable to the police; statistically, poison-murdering wives are even supposed to be most common in park villas.

Normally, the B plan states very specifically what is allowed. For us, for example: single-family house, gable or hip roof, minimum 25 degrees pitch, max. 1.5 floors, renting allowed, changing tenancy not allowed, thus no holiday apartment rental, one granny flat permitted, semi-detached house also allowed. So everything is clear. What did you not know or did you overlook? Karsten

As long as the development plan does not explicitly restrict/specify the number of residential units, there is a difference between a single-family house and a multi-family house.

The interesting question is how large the apartments will be, what standard is aimed for, and whether they will basically be condominiums or one owner of the property.
