Development Plan - Fences / Retaining Walls Question

Hello,

I have a few questions regarding the interpretation of a development plan (Baden Württemberg, LK Karlsruhe).

It concerns the topic of enclosures / retaining walls and how this part of the development plan should be interpreted so that the execution can be done correctly later on.

I have already asked the municipality (building authority) and the responsible county authority about the interpretation, but did not receive any real answers because both offices referred me to the other office. Even a well-known civil engineer had difficulties with the interpretation.

Here is the excerpt.

The following things are unclear to us:

- How is above / below the terrain profile to be interpreted? Is it about the planned terrain or the existing terrain?

- What is the "additional placed fill height" or where can it be seen/found? Or is it our planned (future) terrain profile?

- Are the "walls as enclosures" also retaining walls or are they something like garden walls (without a supporting function)? -> The background of the question is that the developer of the building area has executed all retaining walls with wall panels and not as natural stone walls.

These questions arise because the plot is about 2m lower at one corner towards the neighbor than the rest of the plot, and we are currently considering how best to level the plot (within the allowable limits).

Perhaps someone can shed some light or show us their view of the interpretation :)

You need a retaining wall above the terrain profile if you want to fill up. This is allowed up to 0.5m on the property boundary, unless you fill up in the area of a NA/St/Ga, then the retaining wall may be 1m high.

Hopefully it doesn’t need a retaining wall.

Not surcharge but fixed surcharge height. You find it under the section "1.7.2 Requirements for terrain shaping in certain areas" on pages 10 and 11 of the text document of the development plan. It would be silly to forbid surcharges over 0.5m in one place and require 1.8m elsewhere.

This procedure is, in my opinion, in accordance with the specifications of the development plan.

The best is to adapt to the property.

... wasn't really a question. The OP only reported that he is contemplating alignment with at least one other person. Since we don't know the property here in the forum, we can't participate in that. And what does "align" even mean? To what? How far? With what goal?
