Development plan deviations - the neighbors do not want to agree

Hello everyone,

we discussed our building plans with our neighbors last week. Since we would like to deviate from the development plan, we thought that would also be very good.

In our development plan, a ground floor finished floor height is specified. Unfortunately, this is below the street level. Therefore, we intended to raise this height. (Our house is limited by a value from the single-family house along the outer wall to the outer roof surface).

Now, some neighbors say they do not like that because from their view the house would then be much too big. Others are concerned that our house will cast too much shadow. (According to a shadow calculator, the neighbors lose about 1-2 hours of sun on the terrace from mid-November to mid-February).

Is a building permit possible despite these concerns?

The neighbors would like us to have our entrance lower than the street. However, we do not want that.

As an alternative, we could build the house wider. This would cause the roof to extend further down, and we would then be compliant with the development plan. The house would be the same height, just wider. We would just prefer to avoid building more area than necessary.

I did not agree to this either. Reasoning. The property is defined as one where building downhill is required. This is technically feasible and has been tested millions of times. You want to reverse these topographical conditions, build up so that it becomes higher than the street, at least equally high. This will make the building tower over the neighborhood and take away view and light. Why should I agree to this? And why should the development plan be overridden here contrary to all technical standards? Just because someone doesn't like having to go down to the door? No reason for approval.

The street is quite short and all the houses next to ours are at street level. Only on our property should that not be the case. That would make only our house smaller than all the others. We also would not have to build up.

Now I lack expertise. I should have Plan B in mind and possibly local knowledge. However, the fact is that, according to my life experience, B plans do not demand senselessly.

In my life experience, B plans are often created in a ridiculous and unprofessional manner by offices that fail to at least take a look at the conditions on site. If the neighbors do not cooperate, however, it becomes difficult.
