Development plan - Appearance of basement floor

Hello everyone,

we are interested in a building plot (gap site) in a well-established residential area. The surrounding houses are mainly prefab houses built in the 70s. It is a hillside plot and the plot lies slightly lower than the street level. We want to build two stories with a cellar or basement. The plan was to leave the cellar "open" on the valley side and realize a granny flat there.

Now we have had the development plan sent to us. It is from 1963. It literally states:
>> For two-story buildings, the basement or cellar floor must not be visible. It must be constructed so that the building does not have a stilted appearance <<
What does this mean exactly? Does the cellar have to be completely underground? Or is there room for interpretation here? What is meant by a stilted appearance?
A granny flat in the basement will be difficult if it has to be completely underground :-(

Hello raumhafen,

in my opinion, your questions can only be clarified in a conversation with the responsible caseworker at the building permit authority. He presumably has detailed knowledge of the local conditions and the application of the development plan provisions in the already implemented construction projects. Here are just a few counterquestions that immediately come to mind:
- How steep is the slope of your property and the surrounding plots?
- Are the provisions of the development plan even implementable due to the topography of the property?
- Are there any special features that affect only your property?
- How have the neighbors built?
- Have any exemptions already been granted that you might be able to claim for your construction project?

My recommendation: Take a site plan (preferably with elevation data), plans of your dream house, and some photos of the surrounding buildings and make an appointment for a building consultation.

Even better, try to arrange an on-site appointment with the responsible caseworker.

The building authority wanted to exclude very large buildings, which arise, among other things, from 2 floors + an elevated basement.

What would the view of your desired house from the street look like? Suppose you only see 2 floors here (ground floor and attic) and the basement with a granny flat would protrude to the other side. That might be a starting point.
