Determine the selling price of the property

Hello everyone, the municipality wants to buy an area on the outskirts of the town and convert it into building land. The area contains several plots of land each with different owners, of which I am one. The standard land value in the town is 195€. The standard value of the area the municipality wants to buy is currently 40€. There was already an attempt by the municipality to acquire the land, but it failed due to the low offer price. Approximately what price can be demanded for the land? In the first attempt in 2019, one of the owners wanted a higher price than the rest. Can this person be overruled? Possibly expropriation possible?

Expropriation for a development area is not possible for land. The question would be whether the development area can possibly be realized with small adjustments without the last owners, or whether it is a key property.

When comparing prices with the BRW, you have to consider that costs for development and the like are also included there. In my experience, at least 25-50 EUR/sqm. In addition, usually only about 60% of the gross floor area is sold as building land. The rest is used for roads, playgrounds, compensatory areas, and the like.

Therefore, I would consider about 40-50 EUR for land with building expectations to be justified.

The development costs from the municipality were stated in my (Erbpacht) contract at around €105! And the BRW with us was over €300 just under 3 years ago. I also see a maximum of €50 for owners here, no matter how much pressure there is. Presumably, the municipalities' hands are tied regarding the QM prices.

I'll start from the end:

A plot of land can only be sold by the owner, who makes the decision solely and alone. No one can overrule them, who would that be? – or are you just a co-owner in an inheritance community? (then "expropriation" would be the wrong term, but the co-heirs can possibly request a partition auction). Otherwise, my question would be: who and why currently expects a different attitude toward the purchase offer than four years ago?

I would not be interested in sales price potentials at all, as I would currently not exchange expected development land for money – at least not if further development would be within reach in the near future. To advise you more specifically, you have so far told too few "details."

One more reason for a smarter deal than "land against money."

The expropriation of a plot of land due to a development area is generally not possible, but beware. Here, a plot of land was already expropriated (of course, we received the official price). However, a sports field was built here, and then public interest counts more than private interest. I am no longer sure whether this was possibly also justified by the attached playground.
