Unfortunately, our building permit looks bad.
We had applied for an exceedance of the eaves height specified in the development plan by about 1 meter, and this was rejected in the city council meeting.
As a comparison object, our architect cited the neighboring house with the same eaves height, but since it was built before the development plan came into effect, this was not accepted.

This concerns the development plan of the city of Teltow "27a Komponistenviertel" and we are located in WA2.

Decide what you actually want to challenge – the rejection of the exemption application OR the definiteness of the regulation; you cannot seek protection against both at the same time.
To cite yesterday’s law as an argument had to fail as expected. For twenty centimeters the council probably would have been lenient in the end, but with a whole meter, you have seriously overstepped the goodwill. Now to come along, whining, "your regulation may not even be valid," adds an undignified handling of the defeat to the audacious attempt. Scratching and biting, only

This is your first post here, there is no post with the house design in question – thus it is also not clear which good reasons might exist or better said have existed. Because even if there had been a smarter justification than "the neighbor has it similarly" – now you don’t need to add that anymore – you have fallen into disgrace with flying colors in the decisive committee. That was unwise. Without knowledge of the design, we can only regret this – with (such knowledge) there would be the possibility to suggest a concrete re-planning to you.
