In this case, the shell builder is responsible for his trade... however, you will probably never find out if he wrote that down anywhere ;). But it’s already starting off well :(

Contract for work and services -> Success owed -> Obligation to pay after acceptance of the contractually owed work -> no acceptance here due to damage -> no acceptance = no payment owed.

Sometimes things are that simple. ;)

Yes, I have construction all-risks insurance as well as owner’s liability insurance. This also covers such damages. According to the construction contract, however, the contractor has committed to taking out insurance for his trades himself.



Well, the price is fixed... he will have to justify any additional charges in writing if he demands any extras somewhere. This can really only arise from special services not agreed upon in the construction contract... I have now sent him the pictures and pointed out the damages. The bricks will be replaced... we’ll see. I will try to inspect it on site so that the chipped bricks are not used.

Chipped stones can still, for example, be made into halves that are needed at wall ends or openings. So it is not a total loss for the contractor.
