Hello, we have purchased a building plot (approx. 700 sqm) from the municipality since November 2013 (a 10-year-old new development area). We wanted to start the construction preparations yesterday and remove the trees on site. But when we arrived there, we saw that in the middle of our property a construction container as well as various building materials such as insulation mats, cement, etc. (approx. 300-350 sqm) had been stored and cluttered... We were there over the weekend and nothing was there yet. No one asked us if they were allowed to place anything there. All the material belongs to the construction company from the street opposite. We wanted to speak to the site manager immediately, but he was not on site yesterday (according to the workers we met there). Today we were able to speak to a site manager who could speak German only with difficulty and said there was otherwise no place where they could store all this. I then said that everything must be removed by Saturday as it is our property and we will start building here ourselves soon. He just said there is no space here. What rights do I have? - ??? Who is liable if something happens? - I believe I would be responsible if they get injured on my property since I am the builder of our property...? I only said that one can also have the municipality close a street and partially place the material on the street, which involves additional costs... - is that correct? ([Spielstraße mit zwei Zufahrten]) I am now completely speechless about what I found there and do not know how to proceed. I would be very happy about your answers. Thank you

Call the police and declare a restricted area!

Where will we end up if everyone can leave their trash everywhere.

Alternatively, call the city sheriff!

Simply remove everything that is lying on your property... he should see for himself where to get new stuff from

Insanity. Has your future neighbor ever talked about this topic? I would discuss it with him. Hopefully, he will realize that it's not acceptable. Especially if you yourself are now going to start building. There could also be problems with the insurance if something happens. If he does not have it cleared immediately, then for good neighborhood relations

Talk to the client, if there is one. He has to sort that out. That is not your job. Maybe you can find a compromise, after all, you will have to live next to each other for a while in the future. Otherwise, he will have to figure out how to manage it.

It is his responsibility because it is his property, and whether the OP informs the contractor (BU) or the client doesn’t matter, since the usage is definitely not agreed upon and therefore must be vacated immediately upon request.

Options:

- the user vacates immediately
- the user pays rent
- fence off the property or make it inaccessible to the user
- involve the police

That the contractor (BU) has no space for his materials is not the OP’s problem, especially if the contractor didn’t even ask beforehand whether he could (partially) use the property. If the contractor won’t get it, I would simply load up his insulation material and take it away – that will lead to a terribly quick solution.
