The building insurance goes out today. The shell fire insurance is included. It will probably be Domcura, as they are among the top for price/performance both at Check24 and Comfortplan. It is important to me that gross negligence is included.

Then I just need to find a good construction all-risk insurance.

The interesting point is §644 of the Building Code. So he is liable for damages but not for theft.

Bürgerliches Gesetzbuch (Baugesetzbuch)
§ 644 Gefahrtragung
(1) The contractor bears the risk until the acceptance of the work. If the client is in default of acceptance, the risk passes to him. The contractor is not responsible for the accidental loss or accidental deterioration of the material supplied by the client.
(2) If the contractor dispatches the work at the client’s request to a place other than the place of performance, the provisions of § 447 applicable to purchases shall apply accordingly.

I just looked into a residential building insurance as well. Does anyone know what it means if gross negligence is insured, but in the case of a breach of obligation it is limited to €50,000?

I find it hard to grasp what a breach of obligation is.

If the house burns down due to gross negligence, €50,000 is not enough.

A contractually agreed behavior of the policyholder. For example, pay your premium, report damages, cooperate in damage mitigation.

I also googled that. But I find it difficult to make the connection to gross negligence.

Negligence is part of the causality of your actions and the damage. Window left open --> Burglary.

The obligation is a contractual ancillary duty, e.g. to report damages within a certain period so that the insurance can, if necessary, send an expert. There was a fire --> you do not report the damage within 24 hours --> traces of the cause of the fire are destroyed by rain on the second day.
