Construction Delay Notice - Who needs to be informed and how?

Hi,

if due to night frost (or generally weather-related reasons)
various works cannot be carried out
and this leads to a delay in the guaranteed construction time,

does the developer have to inform the client in writing?
Who else has to be informed? The building authority?

Where could the client get information
whether the developer has made a construction delay notification? (...other than from the developer themselves)

Is it clear that the construction period guaranteed to you cannot be met? How do you know that? The building authority does not care when construction takes place. No one has to be informed. If in doubt, the construction project will take as long as it takes until the building permit expires.

Basically, it really doesn’t matter. The vast majority of contracts allow for a delay due to bad weather periods, it can’t be any other way (unless you build the houses in "tents"). If this is also the case with you, it doesn’t matter at all whether you receive a notice about it or not. The delay does not change because of that.

Of course, communication is everything here as well, because you can prepare for the later move-in by means of a construction delay notice. I would call your site manager appointed by the builder.

Hello, I also assume that there is a bad weather clause. It also depends on what kind of contract you have. Construction service contract or work contract? In the work contract, the site manager or the contractor must report bad weather. The bad weather report must be documented. Usually via the weather report from the nearest weather station. The contracting party, i.e. the client, must be informed about the bad weather report as this time can be added to the construction time guarantee.
