Child allowance dilemma due to inheritance

Hello everyone,

the following concern:

I am a father of three and currently in a really bad situation.

My mother has terminal cancer, life expectancy according to doctors is a maximum of 12 months.

She owns a paid-off condominium, which my brother and I would logically inherit.
We do not own any property yet, so it would be my first property.

However, I have just recently bought a plot of land and will now look intensively for a developer to realize the construction project as quickly as possible.

Now to my question, let's assume my mother passes away before the construction or building permit, then on paper I already own a property through inheritance and would thus lose the entitlement to the Baukindergeld (child construction grant), right?

In that case, I could only renounce the inheritance and leave the apartment to my brother as sole heir in order to receive the Baukindergeld subsidy... if I see this correctly?!

My relationship with my brother is good, I could also leave the inheritance to him and then have myself entered again in the land register?! But one does have an uneasy feeling, since the condominium is probably worth about 230k.
And legally I would have zero claim to the apartment if I renounce the inheritance...

Or one inherits the apartment in memory of their own mother and keeps it as a remembrance of her. Since the value of the apartment (230k) should be enough to console someone for waiving 36k Baukindergeld... Or am I seeing this wrong?

It doesn't happen that quickly with inheriting. You only become the owner once you are registered in the land register. After your mother's death, the will first has to be processed at the district court (if it is not held by the notary). This can take some time. Land registry offices also sometimes work very slowly.

Fact 2) At the time of signing the purchase contract, none of the household members may own real estate,

aukindergeld is only available until 2020, so the inheritance of an apartment BEFORE signing should not be a problem, AT signing it must have been sold. Inheriting AFTER signing also poses no problem. You then have the cash from the sale in your account, and it flows to you in 2020 or, hopefully, later.

If you disclaim the inheritance, it is not your brother who inherits your share, but your children. Does your mother have more to bequeath? It is conceivable that your brother then receives the apartment and you, for example, the corresponding investment accounts or whatever.

Hm actually Baukindergeld is supposed to be for families who otherwise could not afford to build. Apart from that, the 115 thousand € would certainly be a nice equity - of course only if your brother can pay you out or you sell.
