I would put it differently. The garage is not a boundary structure anyway, as it is one meter away from the boundary. [Baulast] still enables the construction (presumably taking over the setback areas, which is why there is also the 2m indication on the neighbor's property).

Yes, whatever. The possibility of full boundary development remains.

Everything within 3 meters (RP 2.50) is boundary development.

Ah ok, I thought I had read that boundary construction was only directly on the boundary. All right. Then I would also say that the building encumbrance has allowed the encroachment here, but has not transferred it, and thus the account of the normal boundary construction is, of course, already exceeded (allowed). You can only not additionally use your overdraft facility that you set up just because you are in the tolerated encroachment.
