Build on the property boundary

according to the development plan, a carport may be built on the property boundary up to 9m. The distance limits are 3m. Does the neighbor need my written consent if he wants to build the carport longer? If I do not agree, can he still build it? ([Nachbarschaftszustimmung im Baurecht])

Can yes, but normally probably not allowed.

Does the longer carport cause you any disadvantage?

The long carport with additional outbuilding (tool shed) will then completely block our southern view and will extend almost to the end of the property. The carport starts from the front boundary of the property at 11m.

Well, I'll keep thinking: I doubt that any objection will help you there. The result will be that your neighbor builds a 9-meter carport and a garden shed at the back. He is allowed to do that, and in the end, you are in the same situation as with the carport. How long is the carport supposed to be?

The carport with integrated tool shed will probably be a total of 12m. But the neighbor doesn’t ask us for free whether it would bother us.

Then just talk to your neighbor and explain your concerns. Maybe there is another solution that you are both happy with.
