Not necessarily. If local conditions require it, the building regulatory office can make an exception, so that for example with a 5m distance between the buildings, the boundary is set at 2.5m each or also 3m and 2m ... WITHOUT ... registering a building encumbrance, or the buildings are allowed to have this reduced distance. Registering a building encumbrance would make no sense in these cases either, because it does not create more space, but there is already too little available.
