brown spots above the fireplace

that sounds quite "harsh". The stains are located above the fireplace. So then, use a different color after all.

We had something similar in our old apartment as well, in a corner of the living room. No fireplace, no smoking household, just heating and occasionally candles in the room. Under the black corner were electronic devices (multi-media computer, monitor, AV receiver, etc.) and next to them was the heater. I then attributed it to the warm air rising from the heater and electronic devices (chimney effect) and small dust particles settling on the wall and ceiling.

Ok, have you done anything about the deposits? We will talk to the painter and chimney sweep.
