Well, we don't know, and the OP probably doesn't either so far. I would refrain from speculation until he reports on the outcome of the inspection.

Not at all. Because if a retaining structure is planned, you do not need to use the neighboring property at all, unless you need a tied-back retaining structure.

Or you simply want to drive over there with an excavator and store the soil that will be backfilled in between, because transporting it away and back would be a considerable additional burden...

First, let someone explain exactly what is going to be done. A general “they are not allowed to do anything!!!1!!!!11” can backfire.
