Balcony beyond building boundary

Hello,

we have this 3-meter building boundary all around our property (or at least soon our property ) (I believe this is regulated by law). In our current plan, we have a balcony that would probably extend beyond this 3-meter limit.
Can someone tell me if this is allowed? Or is this not a question that can be answered in general?

Hello Tatze, the 3m rule concerns the so-called distance area boundary to the neighboring property. As a rule, you are not allowed to build anything in this area, as otherwise your distance area would be on the neighboring property. If you now get along well with your new neighbor, you might be able to convince him to agree to an encroachment, i.e., the takeover of a distance area. But it is best to get advice from your architect on this, as he usually knows the local conditions better. Regards MisterL

Hello, these regulations are to be taken from the building code which is state law. Thus, the exact legal situation depends on the federal state in which the building is constructed.

In NRW, for example, balconies may extend up to 1.50m beyond the outer wall without triggering a separate setback area. However, they must still remain 3m away from the property boundary.

We only have to maintain the 3m on one side. On the other side, we are allowed to build the balcony and garage directly up to the neighboring property.

Why do you only have to keep the 3m distance on one side? Special regulation? The garage part is clear, but what distance does the house have if the balcony goes right up to the neighbor's property?
