that's clear. If you already cause trouble beforehand, all the plots will very conveniently already be reserved. You can probably only realize such a thing after the purchase through legal action. In other words, buy and then recover the price difference through the court. But you should have very well clarified beforehand what your chances of success in court are.
It won't make you any more popular in the community either, so I would skip it for 5 €/sqm. However, for the 80 €/sqm difference that is often asked for here in Bavaria, I would go to court without batting an eye (if I am really sure I will win).

If the litigation process were that easy, surely someone would have done it already. Some suitable lawyer must also be affected by this regulation and would have fought their way through.
