Are plots more expensive for outsiders than for locals?

Hello everyone,
is it legal that building plots (sold directly by the municipality) are sold more expensive to outsiders than to locals? I have heard something along those lines. We had to pay €90 per m² (very rural area) because we have never lived in this municipality and are not registered there, thus count as outsiders. Whereas locals only had to pay €85 per m². However, the purchase was completed back in December 2015. Overall, it is about just under €2200. If it was illegal, it probably still wouldn’t be worth contesting it. But what is the legal situation? Thank you very much

I mean, that’s not allowed. But municipalities like to use a trick where they give the money back to their own residents indirectly through a construction cost subsidy. However, they are allowed to do that. Municipal self-government, I am allowed to promote the acquisition of property for my citizens, I don’t have to apply the subsidy program to outsiders.
If the municipality, however, interposes a municipal enterprise in the form of a GmbH, for example, then the actions are freer. Then I can say: You pay this, you pay that. The car dealer, depending on the customer’s negotiation skills, also sells the identical car at non-identical prices.

This is called the local model and was nothing unusual until it was overturned by the European Court of Justice in 2013. Whether you can still contest this, you may need to discuss with a [RA].

However, I think the effort is not worth it for 2200€.

That was already overturned in 2013? Here, a municipality still offered us a plot in 2014: with a local resident rate of €155/sqm, for us €210/sqm... I already wondered at the time whether that was legitimate, but in any case, it was not an option for us.

These local resident rates are still common in this area to this day.

So with us, the price for locals and non-locals was also explicitly stated on the datasheet of the plots.

I looked at the EU ruling, but didn't get 100% clear from it either.

I won't challenge the price either. It's not worth it, especially since one might want something from the municipality at some point. And the legal situation is not entirely clear to me either.

In Bavaria, the local resident model is still active, in almost every municipality, price differences currently about 80€/m² and without the [Einheimischen Modell] there is no building plot at all.
