Hi,

about 9 months after the house construction, I also went through a separation (unmarried).

I first sought a conversation with the bank (and would do so again). Fortunately, they agreed that I continue the loan alone and released my then partner from liability. No prepayment penalty or similar fees were incurred.

If at all possible, I would also recommend a “clean break” to you.

Regarding the transfer of ownership, notary fees and property transfer tax apply. Unfortunately, you cannot avoid these (keep in mind that they are due on the value of the land including the house – you know this if you bought from the developer).

Sorry for you how it turned out. However, one should not necessarily put the girlfriend on the spot, as there are usually two sides to the story.

I hope it will at least be a lesson for the others and that they think twice beforehand before indebting themselves for such a luxury item like their own house/apartment by using the parents’/grandmother’s etc. house/apartment.

I wouldn’t have thought I’d get so many answers here! As I said, we don’t want the topic "back to the old state". Actually, (by now) it’s about us getting through this without major problems.
If I had doubted back then that you’d leave me shortly afterwards, I certainly wouldn’t have done it. Love can make you blind, but that’s my problem in this case.
Question about notary fees and real estate transfer tax: Notary fees shouldn’t be that high. The real estate transfer tax should relate to 25% of the property value, right?
It’s not a new building either, but an old building from '84. I don’t want to put anyone on the spot, that doesn’t help either party...
I will seek the conversation with the DSL Bank, does anyone have tips in case they try to sell me something? Such a calculation, whether I have enough creditworthiness, shouldn’t actually cost anything, right?

Ahoy! Okay, I spoke with the bank. The debt release has not existed at DSL Bank for 3-4 years now. Now other plans are needed... The office of my financial broker (as a franchisee) has been closed. The next contact person from the same company is about 100 km away. I will now try to check my creditworthiness with him. The bank told me that it is not unusual for a partner to move out and remain in the loan agreement for the time being to reduce costs. Between the two parties, a contract would then be made for me to take over the complete repayment installments. Is it possible to set up a contract between two partners that also includes the waiver of the moved-out debtor after taking over the loan agreement on the 25%? Or does the registered share in the land register override any contract drawn up? Do you know what I mean? :-P Many greetings! Jan

They do not deal with individuals in pending situations. I had to change my bank after 10 years.

If you then do not pay your installment to the bank, the bank will turn to your ex. From your ex’s point of view, this is absolutely untenable, as your actions latentely threaten her existence.
Many things can be agreed upon notarizedly.

Stop listening to the many similar advice and make a really clean break.
