Basically, the owner of the forest is liable .... if he can demonstrably fulfill his duty of inspection.

The municipality will fulfill its duty of supervision through the responsible forestry office; anything else would surprise me. However, trees still fall, especially in peripheral areas, which cannot be prevented. What I would be interested in – there are development plans in which no outbuildings or structures are allowed at all. Not even a doghouse; absolutely nothing is allowed there, no shelter, no patio, not even a fixed fire pit. In this case, the municipality could include such a restriction in the development plan for the areas where windthrow is to be expected or must be expected. If then – no matter what – something were to be erected in this area, it would always be an illegal building and thus unlawful. If this is not stated in the development plan, it would mean conversely that one could also erect something in the endangered areas, which, however, is potentially unwise. But I am now sure that this clause does not come from the municipality but that the municipality’s insurers instruct them to include a corresponding wording in the development plans. Ultimately, both should be able to provide information about what is allowed to be done in the respective areas and what is not and what happens in the event of damage. Regards Dirk Grafe
